Introduction

Welcome to Delivery Bot Master (hereinafter referred to as “Service”). These Terms and Conditions (hereinafter referred to as “Terms”) govern the use of our Service and constitute a legally binding agreement between you (hereinafter referred to as “User”) and Delivery Bot Master. By accessing or using our Service, you fully agree to these Terms. If you do not agree with any part of these Terms, we ask that you do not use the Service.

Description of the Service

Delivery Bot Master offers the beta version of a bot (hereinafter referred to as “Bot”) designed to optimize order management in delivery applications. This Service is in a testing phase, and its performance may vary depending on factors such as the User’s device, versions of the delivery applications, and specific conditions of the operating environment.

User Responsibilities

The User agrees to:

• Compliance with Technical Requirements: Ensure that the device used meets the specified technical requirements for the installation and operation of the Service. These requirements include, but are not limited to, operating system, processing capacity, and connectivity.
• Usage Instructions: Carefully follow all the instructions and guidelines provided in the user manual and installation guide. The User must thoroughly review the documentation before starting the Service setup.
• Modification and Alteration: Refrain from modifying, altering, or interfering with the operation of the Service in unauthorized ways. Any attempt to modify the Bot may result in the termination of access to the Service and loss of associated rights.
• Initial Setup: Perform the initial setup of the Service in a clean environment, without background applications, to avoid interference during the activation process.
• Exclusive Use: Not use more than one delivery application on the same device during the activation process. Only the designated delivery application should be used for the activation process.

Acknowledgement and Acceptance of Manipulation

The User acknowledges and agrees that:

• Manipulation Acknowledgement: Using the Service may involve manipulating the delivery application, which may contravene the terms and conditions of that application. This manipulation may include, but is not limited to, adjustments in order handling and task assignment alterations.
• Assumption of Responsibility: The User assumes all legal and ethical responsibility arising from the use of the Service in relation to the manipulation of delivery applications. The User releases Delivery Bot Master, its affiliates, directors, employees, and agents from any claim, demand, liability, loss, or damage, whether direct, indirect, or consequential, arising from the use of the Service.

Limitation of Liability

Delivery Bot Master is not responsible for:

• Configuration Errors: Any failure in the Service operation resulting from configuration errors by the User. This includes failure to follow the provided instructions or incorrect configuration of the Bot.
• Device Incompatibility: Issues arising from using devices that do not meet the technical requirements specified for the Service. This may include devices with outdated operating system versions or insufficient hardware.
• Damages or Losses: Any damage, data loss, service interruption, or loss of opportunities resulting from failure to follow the provided instructions. Delivery Bot Master is not responsible for income loss or any negative impact on the User’s activity.
• Legal Consequences: Legal consequences, penalties, or damages arising from using the Service to manipulate delivery applications. This includes, but is not limited to, legal actions taken by delivery application providers, regulatory authorities, or affected third parties.

Limited Warranty

The Service is provided “as is” and “as available.” Delivery Bot Master does not guarantee that the Service will be error-free, uninterrupted, or defect-free. The User understands and agrees that:

• No Express or Implied Warranties: No express or implied warranties are offered regarding the functionality of the Service, its suitability for a specific purpose, or its uninterrupted continuity.
• Service Failures: Any Service failure may be related to how the Service is used or configured and does not imply a guarantee of continuous or error-free functionality. The User agrees that Delivery Bot Master is not responsible for such failures.

Refunds

The refund policy is established under the following conditions:

• Refund Conditions: Since the Service’s operation largely depends on the correct implementation and use by the User, refunds will not be granted in cases where the Service fails due to configuration errors, misuse, or User negligence. To request a refund, the User must provide clear and convincing evidence that the failure is attributable to an error in the Service and not to a User error or misuse.
• Request Process: Refunds will be evaluated at the discretion of Delivery Bot Master and may require the submission of additional documentation to corroborate the nature of the problem and its cause.

technical Support

Delivery Bot Master offers technical support via Telegram 24/7. Support includes:

• Setup Assistance: Help with the initial setup of the Service and troubleshooting basic technical issues related to the Bot’s operation.
• Support Exclusions: Technical support does not cover issues proven to be caused by User errors, Service misuse, or problems arising from incorrect configuration. If the issue cannot be resolved through technical support and it is proven not to be a Service failure, additional charges for technical assistance may apply.
• Support Conditions: Support is subject to availability and the terms set by Delivery Bot Master. The User must follow the provided guidelines to receive effective assistance.

Modifications and Updates

Delivery Bot Master reserves the right to modify or update these Terms at any time. Modifications and updates will be handled as follows:

• Change Notification: Any significant changes to the Terms will be notified to Users through the official website, email, or other communication methods. Minor changes may not require direct notification.
• Acceptance of New Terms: Continued use of the Service after the publication of modified Terms will constitute acceptance of those updated Terms. The User is responsible for periodically reviewing the Terms to stay informed of any modifications.

Jurisdiction

These Terms will be governed and interpreted in accordance with the laws of Colombia. In case of dispute:

• Exclusive Jurisdiction: Any dispute arising in relation to these Terms will be subject to the exclusive jurisdiction of the courts of Colombia. Any attempt to change jurisdiction or challenge the exclusive jurisdiction of Colombian courts will be considered invalid.
• Jurisdiction Limitation: The Colombian courts will have exclusive jurisdiction to resolve any dispute arising in relation to these Terms. The User agrees that any legal action will be carried out exclusively in these courts.
